Terminology

Any photo session is a maximum of your 4 children with two parents, I can accommodate more people, however an extended appointment will be required and have to be charged at the current shoot fee.

 

Copyright

The 1988 Copyright Act assigns the copyright to the Photographer.

It is contrary to the Act to copy, publish, reproduce or store our images electronically, unless the express permission of Nicola Sanders Photography. has been sought and or purchased. If permission is granted, then transfer of the copyright commences only once payment for the copyright has been made in full.

The Client may not (either personally or via a third party) alter or add to or manipulate a picture by means of computer or any other technique or reproduce a picture in whole or in part as an element within, or as a montage with, another picture. I never provide the RAW versions of our images.

 

Display

The Photographer reserves the right for any photograph created during sessions to be displayed in the studio, portfolio, or in any other advertising directly associated with Nicola Sanders Photography, I will contact you for authorisation prior to any use for specific authorisation.

 

Force Majeure

Every effort will be made to carry out the contract but its due performance is subject to alteration or cancellation by us owing to any cause beyond their control (eg acts of God, change in legislation, floods, fire, computer failure, etc). In the unlikely event of total photographic failure or cancellation of this contract by us, liability shall be limited to a full refund of all monies paid.

 

Law

These Terms and Conditions shall be governed and construed in accordance with the Laws of England.

 

Liability

Nicola Sanders Photography. shall not be liable for indirect loss or third party claims occasioned by delay in completing the work or for any loss to our customers arising from delay in transit. Where work is defective for any reason, including negligence, our liability (if any) shall be limited to rectifying such defect.

 

Licence

License shall be granted artistic licence in relation to the poses photographed, the location used and digital retouching. Nicola Sanders Photography.  judgement regarding the locations, poses and number of photographs taken shall be deemed to be correct.

 

Photographs

All photograph sizes are nominal.

The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching.

In the case of part mono/part colour images, the colours used will be subject to the photographer’s artistic interpretation and will be deemed to be correct.

 

All photographs supplied by Nicola Sanders Photography. are produced to the highest standards using the best quality materials and latest processing techniques.

 

However, all printed photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass or UV glass. Framed prints or prints should NOT be kept in areas where the atmosphere is subject to higher than normal humidity content.

 

Nicola Sanders Photography. cannot accept any responsibility for this gradual image deterioration.

Digital images are supplied by a downloadable link, please ensure you copy your digital images to another hard drive or preferably to a cloud storage service, like Google Drive, Box or similar.

 

All products purchased are presumed to have been received in good condition unless the Client notifies Nicola Sanders Photography. in writing of any discrepancy or error within 7 days of receipt.

Prices

All services and/or goods are supplied at the current prices ruling at the time of supply and are subject to change without prior notice.

 

Payment

It is worth being completely clear about how you can pay for your gorgeous images. Here I set out all options open to you. I accept pay-pal payments to info@nicolasanders.co.uk or via Bank transfer which I will send you details on request.

Storage of Images

Your images are NOT kept after the viewing, our storage capacity is reserved for production of current images from shoots only. Nicola Sanders Photography offers no guarantees with regard to electronic storage of any digital images, though I practice strict daily backup routines I cannot be held responsible for the loss of images due to equipment failure or any other reason beyond our control. If you have lost your images by all means give me an email and I will see if I have them but I will not be held accountable if they are not.

 

Refund Policy

All orders are bespoke, I will not refund, nor accept the return of or refusal to pay charges for any technically acceptable photograph supplied as a digital file, framed printed image or any other form of media.

No exception can be made as I cannot be held responsible for individual tastes or exceptions. Your signature on the order form and payment form a contract between you and Nicola Sanders Photography.

 

Cancellations / Rescheduling

I maintain a strict cancellation policy.

In the event of cancellation of a paid shoot, I need to have 24 hours notice to date of the shoot or you will forfeit the shoot fee. Cancellations may only be made by telephone.

 

Our rescheduling policy

Our rescheduling policy is the same as our cancellation policy it applies to any shoot appointments made at Nicola Sanders Photography, you may reschedule once as long as you give us 24 hours notice, as above, any further reschedules will be subject to the booking fee being non refundable.

 

Data Protection

In compliance with the Data Protection Act 1998, personal data supplied to Nicola Sanders Photography may be stored for future use. This data will only be used to inform you of future opportunities, and to be kept up to date and will only be held as long as is necessary. Nicola Sanders Photography will take all necessary steps to ensure the information is held and used in accordance with the above Act.

However, should you not wish the data to be stored and/or removed please contact us at the address at the top of these T&C’s.
